Reasons to Use An Eviction Attorney

If you are a landlord long enough, you will eventually have to evict a tenant.  For many landlords, making the decision to finally evict the tenant can be the toughest part.  You can certainly do the eviction yourself, but many landlords find that is easier to use an eviction attorney to go through the process.  Here are some good reasons to use one:

  • Time-Unless you are self employed, filing an eviction and going to court will require you to take time off at work.  Do you really want to spend your vacation time to sit in court and wait for your turn?  In my experience each eviction will take 3-4 hours of time during the normal business day.
  • Expertise-An eviction attorney specializes in evictions and will know all the legal ins and outs of the process.  If the eviction is not done correctly, according to state and county laws, you may have the case thrown out by the judge and need to start all over.  This costs not only money, but additional time.  Let an expert do the work for you.
  • Unemotional-Let the attorney be the bad guy.  Tell him what you want to and let him play hardball with the tenants to get them to pay the rent or get them out.  Most landlords will be too easy on the tenant when the owe money and let them out easy.  An attorney is working for you and will do what you want them to (within legal remedies).
  • Legal representation up front-Not often, but occasionally, a tenant may request a trial because they believe there is a legal issue involved with why they are not paying the rent or they had to violate the lease terms.  By having an attorney involved up front, you may either be able to avoid the trial or at least have your attorney already up to speed when you do have to go.

Having an eviction attorney is a valuable resource for every landlord.
